Shop leases: the option window, the rent review and the outgoings reconciliation you should be checking

Retail leases in NSW carry dates and rights most small retailers never diarise: option windows with strict notice, market rent reviews, and the annual outgoings statement you can dispute.

Short answer: four dates per lease, with long warnings: option window opens and closes (180 days), rent review (90 days), outgoings reconciliation due (30 days), expiry. Under the NSW Retail Leases Act, retail tenants have specific rights around disclosure, outgoings and options; a missed date forfeits them.

The dates

Option exercise: the clause sets a window (often three to six months before expiry) and the notice must be in writing; miss it and the option is gone. Rent reviews: CPI, fixed or market, with a process for disputing a market review. Outgoings: the landlord must provide estimates and an annual reconciliation; you can query it. Make-good: what you owe at the end.
